GXI Privacy Terms & Conditions

When you use or avail of a GXI Product or Service as either a Personal Information Controller or a Personal Information Processor, the terms for personal data processing shall be governed by our Data Sharing Terms & Conditions (DSTC) or our Data Processing Terms & Conditions (DPTC), respectively.

Data Sharing Terms & Conditions

Data sharing – refers to the disclosure or transfer to a third party of personal data under the control or custody of GXI. The term excludes outsourcing, or the disclosure or transfer of personal data to a processor.

Data Processing Terms & Conditions

Outsourcing, or the disclosure or transfer of personal data by a personal information controller (e.g., GXI) to a personal information processor (e.g., messenger), is different from Data Sharing. In outsourcing, the processing of data is limited to the documented instructions given by the controller (e.g., to deliver bills). The processor cannot use the data for its own benefit and purpose (e.g., to offer bills payment services); if it does, then it would be considered as a personal information controller. If that happens, a data sharing agreement may be more appropriate.
